EPA Seeking Public Comments on Proposed Regulations Regarding Aerosol Cans

The United States Environmental Protection Agency (EPA) is currently taking public comments on the proposal to add hazardous waste aerosol cans to those “universal wastes” regulated under title 40 of the Code of Federal Regulations (CFR), part 273. Comments must be received on or before May 15, 2018.

Please submit your comments, identified by Docket ID No. EPA-OLEM-2017-0463, at Regulations.gov.

This change in the Resource Conservation and Recovery Act (RCRA) regulations, once finalized, will reduce regulatory costs of a wide variety of establishments generating and managing aerosol cans, including the retail sector, by providing a clear, practical system for handling discarded aerosol cans.  Information pertaining to the proposed regulation can be found at the following link: https://www.epa.gov/hw/increasing-recycling-adding-aerosol-cans-universal-waste-regulations

If and when the proposal is finalized, Kentucky will immediately incorporate and implement the final regulation.  This serves as a 30-day notice that Kentucky will incorporate the final regulation as finalized by EPA.
